Adult Support and Protection (Scotland) Act 2007 PDF Print E-mail

The Adult Support and Protection Act came into effect in October 2008.

Main provisions within the Act:

    * Power of right of entry to settings where abuse of adults is thought to be taking place
    * The creation of banning orders so that perpetrators of abuse are removed from those settings
    * Establishing Statutory Adult Protection Committees, operating on a multi-agency basis, to further develop strategic inter-agency working and collaboration.

The Act places a duty on Council Officers to: "consider the importance of providing advocacy and other services".

Unlike the Mental Health (Care and Treatment) (Scotland) Act 2003, the Adult Support and Protection Act does not give anyone the right to access advocacy, instead there is a duty for the council to consider importance of providing advocacy and other services.

The Scottish Government has issued the final draft of the Adult Support and Protection (Scotland) Act 2007 Code of Practice, which will assist with the implementation of the Act.
